PERMITS AND CONTRACT REGULATIONS:

  • CCAP reserves the right to select vendors based on menu, past performance and variety of food to be served.
  • Vending locations are available based on price schedule listed on page 1.

1) NHGP CONTRACT

  • Full payment must accompany completed contract application of to vend. CCAP accepts certified checks, money orders, or bank checks only. NO PERSONAL CHECKS!
  • Contracts and all required accompanying documents are due on August 1st, 2018 at noon.

  • Proof of insurance coverage – CT Cycling Advancement Program (CCAP), the City of New Haven, and Taste of New Haven must be named as additionally insured on a valid certificate of insurance provided to CCAP by vendor and must accompany contract application.
  • Vendors must provide a copy of a valid CT State Tax ID certificate.
  • Vendors must provide a complete Federal ID W-9 form.
  • Each vendor must have his own licensing/permit/insurance and not operate under another vendor’s name and/or license.

2) CITY OF NEW HAVEN HEALTH DEPT. LICENSE:

  • All vendors are required to obtain a New Haven Health Dept. Food Service Operation License.
  • All vendors must contact Brian Wnek at (203) 946-6760 at the City of New Haven Health Department for specific requirements for health licenses.
  • All participating vendors shall comply with New Haven Health Department itinerant regulations. All IV'S and caterers must have valid Qualified Food Operator Certificate.
  • All vendors must be licensed prior to events. No licensing will be issued on premises.
  • Each vendor must have his own licensing/permit/insurance and not operate under another vendor’s name and/or license.
  • • All food vendors are subject to an inspection from the New Haven Health Department prior to opening on Friday night. If the NHHD finds rules are not met, vendor will be asked to leave site. No refunds will be issued for vendor non-compliance.
  • All vendors must observe New Haven Health Department rules and regulations and make their space available for inspection by health inspectors at any time.
  • Participating vendors will agree to attend a meeting with the New Haven Health Department and CCAP personnel to address any issues and concerns regarding the events.

3) CITY OF NEW HAVEN VENDING REQUIRMENTS:

  • All vendors need to apply for a New Haven Umbrella Vending Permit through us.
  • All vendors must be licensed prior to events. No licensing will be issued on premises.
  • If you DO NOT hold a yearly vending permit, you must submit:
    • A copy of photo I.D. (driver’s license or passport),
    • Copy of business’ CT Sales and Use Tax I.D. Form
    • Copy of Paid Health Department License Receipt
    • $60 Payment on top of fee to enter the event
  • If you do hold a yearly vending permit, you must submit a copy of photo I.D. and Business Name

CITY OF NEW HAVEN FIRE DEPT. REQUIRMENTS:

  • All vendors must comply with all rules and regulations of the New Haven Fire Department and make itinerant space available for inspection at any time during the event by the Fire Marshall or
    his representative.
  • Propane is allowed as long as it is managed correctly. Tanks must be secured within their cooking location.
  • Propane tanks are subject to on-site safety inspections from the City of New Haven Fire Dept. prior to event opening.

GENERAL GUIDELINES AND RULES AND REGULATIONS:

  • Vendor agrees to be open for all hours of the event.
  • Vendors must be contained within the vending area designated by CCAP. Prep work must be done in the itinerant area.
  • Vendor set up times on designated dates will be decided upon by CCAP. In addition, vendors agree to breakdown of their area and are off site within one hour of end of the event.
  • Because of street closings, you must be at your station at determined time. Once a vendor is on site, no traffic will be permitted in or out after street closes completely. You will be notified of your set up time-in and placement number prior to the event.
  • Each vendor must remain on site throughout the event. Roads close at 12:00 pm and open once police feel safe to open to traffic.
  • No one under 18 will be permitted to work itinerant space unless supervised by licensee.
  • Each vendor must have metal container with lid for grease disposal and is responsible for disposal of grease off site. No dumping of grease in street or sewer drains. Violation will mean vendor will not be permitted to further vend at event.
  • No dumping of water/ice in street or sewer drains.
  • Vendor is responsible for proper trash breakdown, and removal
  • If you need to replenish stock, you must make arrangements prior to the festival for drop-offs. Contact Dan Tontini at [email protected]. An on-site coordinator will be present at the festival.
  • No vendor parking will be provided on-site. Off-site parking will be available at surrounding parking garages and remember that parking is limited.
  • Vendors may bring their own beverage product for sale. Vendors may ONLY soda and bottled water on-site.
  • The sale and consumption of alcoholic beverages is strictly prohibited at all site locations. Vendors may not consume alcoholic beverages in their designated area.

NON COMPLIANCE OF GENERAL GUIDELINES WILL RESULT IN VENDOR NOT ABLE TO OPEN AT EVENT

NEW HAVEN GRAND PRIX

Chapel St and College Street, New Haven

A. SERVICES PROVIDED BY CCAP

  • CCAP will provide barrels for trash removal.
  • Event marketing, location management, and audience.

B. SERVICES PROVIDED BY VENDOR

  • Vendor will provide one (1) ABC Fire Extinguisher as required by law for tent.
  • Vendor will provide own ice.
  • Vendor will provide own lighting/seating (tents and carts ONLY) for their vending area.
  • Vendor will provide 1 garbage reciprocal for the public at your on-site vending location.

C. COST STRUCTURE AND PAYMENT SCHEDULE

  • The cost is $275 for Food Truck Vendors, $200 for 10' x 10' Food Vendor Space, $300 for 10’ x 20’ Food Vendors, or $175 for Food Carts
  • There will be no commission or % charged.
  • Electrical/Generator power provided for additional $60 fee.

Payment must accompany contract application.

ALL PAID FEES FOR CONTRACT SUBMISSION ARE NON REFUNDABLE

D. INSURANCE, LICENSES AND PERMITS

The vendor, at his sole expense shall obtain and maintain on whatever basis is necessary, all licenses and permits required to be secured in connection with the vendor’s conduct of its concession operations hereunder and all insurance customarily maintained by first class retail operators, including, without limitation, worker’s compensation insurance and general liability insurance. Such public liability insurance shall be in the amount of not less than the following: general liability of not less than $1 million per injury and property damage or occurrence; automobile liability of not less than $100,000/$300,000 per injury or occurrence; worker’s compensation of no less than statutory requirements; employer’s liability of not less than $100,000 for each incidence or occurrence; bodily injury of not less than $1 Million policy limit; and bodily injury by disease of $2 Million for each occurrence

All such policies shall be in the form and substance satisfactory to CCAP, New Haven Festivals, Inc. and the City of New Haven; shall be non cancelable without thirty (30) days prior written notice to and shall name CCAP, and the City of New Haven, and Taste of New Haven as additionally insured. All such policies shall provide that such insurance is primary to The CCAP, the City of New Haven, and The Taste of New Haven’s insurance. All insurance policies required by this agreement shall be issued by companies authorized to do business under the laws of the State of Connecticut and each such insurance policy shall be written by a company rated no less than “A” as to general policy holder’s rating and no less than “C” class 10 as to financial rating in Accordance with latest edition of Best Key Rating Guide published by A.N. Best and Company, Inc.

Certificate of Insurance must be submitted with contract and payment.

Vendors will supply CCAP with proof of this coverage upon return of signed contract. The vendor will also supply the Festival with a valid Connecticut State Tax ID Number and Federal ID Tax Number when contract is signed,

E. INDEMNIFICATION

Vendor hereby indemnifies CCAP, the City of New Haven, The Taste of New Haven, and its directors, officers, and employees, agents, licensees and affiliates against any claim, suit, actions, judgements, damages, costs and expenses whatsoever (including reasonable attorney’s fees and expenses) arising out of or in any way connected with any injury, death or other harm or claim connected with or claimed defect in any beverages, equipment, instrument, product or service provided by vendor or any party affiliated with vendor, whether or not such item or services confirms to any approved standard of quality established hereunder. Any acts, whether of omission or Commission, that may be committed or suffered by vendor or any of its affiliates, servants, agents or employees in connection with the subject matter of this agreement; and/or the performance of vendors agreements and obligations hereunder, including without limitation, the performance by any of the vendors’ agents, employees, affiliates, fiduciaries, subcontractors and/or licensees hereunder, any breach of any vendors’ obligations, agreements and/or warranties hereunder, but excluding any claim, suit, action, or judgement arising out of the furnishing of goods or services not governed by the provision of this agreement.

F. TERMINATION

If vendor or any of its affiliates, agents, employees, fiduciaries, subcontractors and/or licenses fails to fully perform any of its obligations hereunder and if vendor does not promptly cure any such failure to perform in light of applicable circumstances, CCAP in its sole discretion, shall have the right to terminate the Agreement immediately upon written notice to vendor. Vendor agrees that NFHI dissatisfaction with product or service constitutes grounds for immediate termination.

Notwithstanding any such termination of the Agreement (a) all representation, warranties and indemnities under this Agreement shall remain in force (b) CCAP shall reserve all its rights and (c) vendor shall continue to be obligated to account and pay to CCAP all owed fees.

G. ASSIGNMENT

Neither party shall have any right to assign or delegate this Agreement and/or any of its rights or obligations to another party.

H. SPECIAL CONDITIONS

This agreement may be terminated if any of the above mentioned events are canceled for reasons beyond the control of CCAP.
